Initially, states like Florida, California, and others passed laws enabling athletes to monetize their NIL rights. This prompted the NCAA to address the growing disparity between state laws, pushing for a unified federal standard to streamline regulations across all states and institutions.

Legal challenges mounted against the NCAA’s previous restrictions on athletes’ ability to profit from their NIL rights. Landmark court rulings, such as the Alston v. NCAA case, reinforced athletes’ rights and acted as a catalyst for the NCAA to reconsider its regulations.
